• To send WhatsApp messages on behalf of our business clients to their opted-in customers.

3. WhatsApp Messaging Compliance

All messages sent through our platform use the official WhatsApp Business API provided by Meta Platforms, Inc. We comply with WhatsApp's Business Policy and Terms of Service. All recipients must have provided explicit opt-in consent to receive messages. Every message includes the ability for recipients to opt out by replying STOP or a similar keyword.

4. Data Sharing

We do not sell, rent, or trade personal data to third parties. Data may be shared with:

• Meta Platforms, Inc. — as required to deliver WhatsApp messages through the WhatsApp Business API.
• Hosting providers — including Vercel, for platform infrastructure.
• Business clients — who own and control the data of their own customers.

5. Data Retention

We retain contact data and message logs for as long as a client account is active. Upon account termination, data is deleted within 30 days unless required by law. Business clients may request deletion of their data and all associated customer records at any time.

6. Security

We implement industry-standard security measures to protect data, including encrypted data transmission (HTTPS), access controls, and secure storage. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

7. Your Rights

End-customers whose data is stored on our platform may contact us to request access to, correction of, or deletion of their personal information. Business clients retain full ownership of their customer data and may export or delete it at any time through the dashboard.

8. Cookies

Our platform uses minimal cookies for session management and authentication. We do not use advertising or tracking cookies.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify active clients of any material changes via email. Continued use of our services after changes constitutes acceptance of the updated policy.

These Terms of Service ("Terms") govern your use of PUMPA Digital's WhatsApp marketing platform and services. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Services

PUMPA Digital provides WhatsApp marketing and automation services including broadcast campaigns, automated messaging, contact management, campaign analytics, and related features. Services are provided through our web-based dashboard and APIs.

2. Eligibility

You must be at least 18 years old and operate a legitimate business to use our services. By using PUMPA Digital, you represent that all information you provide is accurate and that you have the authority to bind your business to these Terms.

3. Client Responsibilities

You agree to:

• Obtain explicit opt-in consent from all contacts before messaging them through our platform.
• Comply with WhatsApp's Business Policy, Terms of Service, and Commerce Policy at all times.
• Comply with all applicable laws including Pakistan's Electronic Crimes Act (PECA) and data protection regulations.
• Not use our platform to send spam, unsolicited messages, or any content that violates WhatsApp's policies.
• Provide accurate business information and keep your account details up to date.
• Maintain the security and confidentiality of your account credentials.

4. Prohibited Use

You may not use our services to:

• Send spam or unsolicited messages to individuals who have not consented.
• Transmit illegal, harmful, threatening, or fraudulent content.
• Impersonate any person or entity.
• Violate any applicable laws or regulations.
• Interfere with or disrupt our platform infrastructure.

5. Payment

Service fees are billed monthly as agreed in your service contract. WhatsApp API usage fees are billed separately at Meta's prevailing rates. All fees are non-refundable except where required by law. We reserve the right to suspend services for non-payment after providing 7 days' written notice.

6. Intellectual Property

PUMPA Digital retains all rights to our platform, software, and technology. You retain ownership of your business data and customer contact lists. You grant us a limited licence to process your data solely for the purpose of providing our services.

7. Limitation of Liability

PUMPA Digital shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the 30 days preceding the claim. We are not responsible for WhatsApp API downtime, Meta policy changes, or message delivery failures caused by Meta's infrastructure.

8. Termination

Either party may terminate services with 30 days' written notice. We may terminate immediately if you breach these Terms or violate WhatsApp's policies. Upon termination, your access will be revoked and your data will be deleted within 30 days.

9. Modifications

We reserve the right to modify these Terms at any time. We will notify clients via email at least 14 days before material changes take effect. Continued use of our services after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes shall be resolved through good faith negotiation, and if unresolved, through the courts of Islamabad, Pakistan.
